Hello everyone,

There has been a development in this saga. I have been trying to screw up the courage to call the DWP. However, today my son has received a letter from Motability, stating that he has to return the car to them by13th November in order to receive a £1000 cashback. Motability say that the mobility component was withdrawn on 6 June and that he should have received confirmation from the DWP. As he only receives the mobility allowance in the form of the car, there has been no loss of income to alert him to the withdrawal of the benefit.

We have received nothing from the DWP. I have been expecting the form since the end of February, but we have received nothing at all.

This all seems very odd to me. Firstly, that the DWP apparently withdrew the benefit over three months ago without notice; secondly, that we received no communication from the DWP to this effect; thirdly, that have heard the news only today from Motabiity: fourthly, that he still has another two months before the car has to be returned and finally, that any criterion-based benefit can be withdrawn arbitrarily without any assessment.

I'm afraid I still believe my original advice is correct.

You said that your son's award ended before lockdown, this being the case then they had no PIP award from that date and payments in regard your son would have been paid from that date.

It is possible that the DWP have an arrangement with Motability to continue payment to them, although I do not believe this to be the case.

The only other conclusion that you were incorrect about the End Date of the award.

Either way, unless a new award has been made, which from your post is not the case, then his award ended on the End Date and from that date he had no further entitlement to PIP.

Thank you for your quick response, Gordon.

My son has been in receipt of the mobility component of PIP and, previously, higher rate DLA, for 15 years and has always received a new claim form around the end of the award. The end date was definitely February this year but, because of the lockdown and disruption of assessments, I assumed that his form had been delayed. I had, however, expected to receive something before now.

I am puzzled that Motability have received notice from the DWP that his award ended on 6 June and yet they are only now asking that the car be returned and even that not until November 13, when he will receive £1000. By then, he will have had the car for 9 months for which, presumably, Motability have received nothing.

It seems logical that we would have received notification of the end of mobility component and, therefore, the car, at the same time as the DWP informed the garage.

Should we have requested a new claim form, rather than wait for it to arrive, as has been the case for the last 15 years? If this is the case, will this be treated as a completely new claim, rather than renewal or reassessment of an existing claim?

Don't assume that what Motability have told you is correct, if the End Date of the award was February then it ended in February, there would be no continuation of the award until June, possibly the DWP told Motability in June that there had been no new award made.

I'm afraid, if no reassessment form was sent then it is the responsibility of the claimant to contact the DWP to chase one, a lot of our members seem to be struggling with the idea that an End Date means the award ends.

It should be possible for a new award to be made from the day after the last one ended but you will need to be quick in requesting a new form and you may need to argue your case for the Start Date.

Thank you for this. I will call the DWP tomorrow to see what's going on.

I didn't know that we should request a new claim form, as we have never had to do so before. I still don't understand why Motability didn't ask for the return of the car as soon as they heard that the mobility element had ceased, as if this is the case, they have had no payment since February and yet they are still offering the cashback when the car is returned.

Hi Onedaysoon

Claimants of DLA or PIP, who have vehicles through the Motability Scheme, can potentially extend the period for retaining their vehicles.

The good news is if you’re in this position, you can request an extension of the current extended period of 26 weeks. This is in comparison to the standard 8 weeks, after the date of the DWP decision to reduce or remove a claimant’s mobility component award.

After opting for the 26 week retention period and satisfying Motability that you’re actively progressing an appeal, a discretionary extension to the hand-back period can be granted on request.
