Wing, did you send your own medical evidence with the Tribunal request?

Hi Margo

I gave my medical history to the Health Professional who came and gave me an assessment at home. But it was not included in the "bundles" sent to me and the Tribunal by the DWP. Also, looking at the assessment, the HP did not mention it either.

The Tribunal want to see it and I have to get another copy from the GP although they are writing to me with a letter to give to my GP in order to get it.

The Tribunal also want details of my original DLA award which they are writing to the DWP to get.

Don't know if the DWP will still have any details though as it's 20 years ago.

I wonder if the Tribunal itself has kept copies, as I awarded it by a Tribunal. Perhaps somebody here may know the answer.

I would not expect the TS to retain any documents from an appeal beyond the time allowable for a further appeal to the UTT (plus a safety factor), certainly not 20 years.

Thanks for your reply Gordon.

The judge did say the DWP may not have the documents after such a long time but she would request them anyway along with the details of the DLA which I would have thought they would have some details of as it was ongoing until they stopped it last year.

Meanwhile, I have to send in my medical notes to the tribunal. Not sure how much to send in as there are over 100 pages (requested a SARs from my GP). But they show all the relevant medical conditions I have.

I don’t expect you to reply to this post as I know you are retiring from the board. But I would like to say a big thank you for all the help you’ve given me and many others in claiming our benefits. All the best for the future.

Hi Wing

In regards to your medical notes, only send in the notes that will help your claim, I have seen many medical notes over time and not all of them have been useful, you need to cherry pick the ones which support your claim and shows your condition(s).

Thanks for your reply Gary. I suppose the tribunal just want evidence that I have the conditions I say I have.
