Hi all.

Just a random ask if anyone can shed some light on this I will be appreciated.

Can you still receive the SDP part of the award if you are say moved from the ESA SG to the WRAG, or even if your found fit for work?

At present I'm in the ESA SG. Just looking at my options for future reference, if next time after an assessment they decide to either downgrade me to WRAG, or worse case FIT FOR WORK can I still retain my SDP as my PIP is both enhanced ongoing.

As I've said before I will never go onto UC. If I somehow loose my SG status I'd be surprised, but where talking about the DWP here, they will then have one hell of a fight on their hands if I do, as I know IR ESA, I don't need to do a Mandatory first before appeal.

My plan is to drag it out as long as I can if they bung me in the WRAG, or FFW group.

If anyone has the answers it will help me out decide which road to take if needs be. As I said here before my assessment was due in August 2020 but deferred till August 2022 giving me plenty of time to get things in order before I retire and can end this demeaning process once and for all.

I hope everyone understands my question.

Hi ThisGovernmentsGoneToFar

You have not stated what type of ESA you receive (IR ESA or CB ESA).

The SDP became payable from the first day that all three of the following applied.

1. You had an award of ESA and we’re receiving or were entitled to receive Income Related ESA or Pension Credit.

2. You had an award of PIP Daily Living, DLA middle care or AA

3. You met the criteria for payment of the SD Premium, namely that you lived alone or were considered to be living alone and no one receives Carers Allowance against your PIP award, or if anyone lives with you over the age of 18, they are also in receipt of a qualifying benefit.

Gary silly me lol.

I'm on IR ESA and been living alone, receiving SDP for the last 4 years.

Now needing to know if I get moved off IR ESA Support group to either WRAG or told Fit for work that I can still claim the SDP part.

Yes to 1, 2 and 3.

As you have answered yes to 1, 2, and 3, the answer would be ....... yes B)

Remember there are no disability premiums paid with UC, although you might be entitled to transitional protection, depending on your circumstances.

Yes Gary,

I understand the Manage Migration rules regarding this, and there's no premiums under UC. The only change will be is if the DWP try to screw me over. But being on IR ESA I I no I can appeal and adverse decision.

I've made plans if I'm done over by the DWP my council will still cover my rent, and I will live of my PIP till I retire.

All legacy benefits will disappear including HB when everyone is transitioned over to UC, you will then have to claim the Housing Element unless you live in an exempt accommodation.

The last I heard was that by 2024 everyone would have been transitioned over to UC but that was before Covid, keep an eye out for more details in our newsletter.
