Has this happend to anyone else? was created by Honeybear
A friend of mine received her Dla renewal form a couple of month ago.I helped her fill in the form as best we could and returned it within a couple of weeks.Last week she received her award,High mobility for indef period,but Low care component.Her care needs have risen over the last few month,and we put everything on the form, but it was totally ignored.They used her last medical report from march 2010,before her care needs increased. She is now appealing the care component with the help of welfare rights.

Today she expected her ESA payment as usual,but it wasn't in her Bank Account.She phoned the Benefit Agency (Aberdeen)and they told her,after a two hour wait for call back,this:
When she received her renewal form, something triggered in Blackpool,DLA, by a "computer"and advised Aberdeen,ESA,of this and her payments were stopped,despite having received her award last week. I have never heard of this, and I cant see how it could trigger her ESA payments to be stopped, at worst, if the award was taken away, a medical, but surley not stopped.
She has received this afternoon a counter payment from her local Jobcentre plus,and the stop has now been removed.
Iam very confused.

Hi HB,

The ESA award that is current, and any payment for said award cannot be stopped without a re-assessment, and a fresh decision from the ESA Decision Maker, after a new ESA WCA.

ESA and DLA are totally seperate allowances, with different qualifying criteria.

I feel that you have been misinformed.

Would I be right in saying that people have posted that ESA medical and then none awared (the other way around) has stopped a DLA award

Hi Dave,

The DWP have been known to use reports from an ESA medical assessment as evidence in assessing a DLA award, generally where contradictory evidence is evident.

Visa versa is also possible.

However, this does not take away from the main point, which is, a current award of ESA can not be altered or stopped without a fresh re-assessment process, and a fresh decision from the ESA DM.

Hi,

Although it is not apparently relevant to the OP, an award of WRAG, can be suspended for failure to comply with WFI,s or WRA requests.

However again this decision must be made by the ESA DM.

I feel that the fact that the OP received a counter payment of ESA, is proof that an error was made, and the misinformation given seems to be an attempt to cover up said error.

And can I just have something clarified too please? I have just been put into the support group for ESA and my support worker has asked them to send me a form for DLA. If/when I apply for DLA I presume it won't trigger an ESA assessment as they are 2 totally separate things?
