And can I just have something clarified too please? I have just been put into the support group for ESA and my support worker has asked them to send me a form for DLA. If/when I apply for DLA I presume it won't trigger an ESA assessment as they are 2 totally separate things?

Hi,

Applying for DLA shouldn't generally trigger a review of ESA, as you rightly say there are different benefits with different qualifying criteria. However the DWP can use recent medical evidence from another benefit claim to help determine a claim for a different benefit.

expect them to do so more frequently in these austere times. Govt departments will be dexterous in finding ways to save money, but the c riterias are different, and in any such case, always take good advice

I think you could be right XFACTOR!
I'm a depressive and a terrible worrier so could some please indulge me and tell me what the worse case senario could be! A couple of days ago I was awarded ESA support. If I claim DLA which of these 2 senarios is more likely to happen (if they happen at all) a)I won't get DLA because of recent ESA evidence, or b) I get awarded DLA but trigger a review for ESA because of DLA evidence?
Of course I also realise it may be possible to get both ESA and DLA without them affecting each other, and it's also possible to get knocked back for DLA on it's own 'merits' rather than having anything to do with ESA.

I would think that being put in the ESA support group could only be beneficial to your DLA claim. However, from what I have read, I cannot guarantee that 'failing' DLA would not trigger a review of your ESA ...

Nothing on this board constitutes legal advice - always consult a professional about specific problems
