Is there some where you are keeping a record of assessment centres? My medical was distressing to say the least.
I have mental health problems stated and the room was split in two and I could hear every word from next door, which caused me to get really distressed and breakdown.

She refused to move rooms because "there were none". She said the only option was to re book. So I was forced to sit there. I struggled mt way through it and I used my music to calm me down in one ear.
Going to complain but need to make people aware.

i got zero points in total. i paid for the guides, ifilled them in right and igave themevidence too. the medical was traumatic and has made my condirion worse.

i was on hgher care and lower mobility. i completely broke down in the medical. i could hardly function at all but they carried on telling me i could rebook, but that would have made it worse and i exlained that. i was sjaking and crying in the medical.


do i get money whilst i appeal? can i throw the medicalout and instist it get s redone, at wht stage can it happen?
i dont understand how this has happened

I am afraid not, the zero points PIP decision will stand until you can either get it changed at The Mandatory Reconsideration (MR) stage or if not then at any subsequent appeal to The Tribunal.

I am afraid that you cannot "throw the medical out", you could complain to The PIP Assessment Provider (ATOS or Capita) and The DWP about the quality of the "medical" as a separate issue to your MR request, but even if the "medical" was totally discredited, this would only result in an other "medical" and would not guarantee that you received the correct PIP award as the result of it.

I am afraid that this is happening to many DLA recipients when transferred to PIP.

You could make a fresh claim for PIP straight away, but you would have to go through the whole process from scratch and unless you can identify where things went wrong this time, there would be no guarantee that the same adverse outcome would occur once more.

You could make a fresh claim and MR/Appeal the current zero points decision at the same time, but any decision made as a result of the MR/Appeal would only run until the date of the decision made as a result of your fresh claim.

You have one month from the date of the PIP Decision Notice letter to make a written request for a Mandatory Reconsideration (MR) of the PIP decision.

To request a copy of The PA4 PIP Medical Report compiled by the PIP Assessor at your face to face and sent to The DWP PIP DM to be used when the DM came to their decision.

If you have any problems obtaining The PA4 with a verbal request, you can make a written request which should be done as a separate issue to any MR request :

Or you can make the request in the form of a letter, as long as you make it clear that you are making a formal SAR under The Data Protection Act 1998.

Address the envelope : FAO The Data Controller, at the Benefits Office dealing with your PIP.

Write DPA 1998 SAR in front, top, left corner of envelope.

Once received, they have 40 calendar days to comply.

You should not miss your one month deadline if The PA4 or any other supporting evidence that you may be awaiting has not arrived.

You can make comment that you have requested this and will submit further evidence if applicable when you receive it.

Once you have The PA4, you can then pose any counter arguments to the PIP Assessors recommendations.

e.g. If they are stating that you can carry out a particular PIP Activity, has it been taken into account that to be classed as being able to carry out a PIP Activity, you must be able to do so Reliably and Safely for The Majority of Days

If the Assessor has stated that they witnessed you Walking a set distance have they taken into account the above, the time it took you to do so, and any pain, discomfort and breathless, etc that you may have suffered whilst doing so ? etc, etc, etc !!

You should be aware that when you request an MR, any current PIP Awards, Daily Living and/or Mobility, that you might have, can be increased, reduced or taken away altogether, as they will look at the whole PIP Awards afresh.

Obviously if you have no current PIP Award, there is no risk involved.

Once you have gone through The MR Process, if you are still unsuccessful, you have one month from the date of The MR Decision Notice Letter to appeal directly to The Tribunal Service. (TS)

You should do this using one copy of The MR Notice letter (keep the othercopy) and the : SSCS 1 Form (Download Link)

You should concentrate on reiterating where and why you should have scored the extra points with respect to the applicable PIP Activities and the appropriate scoring PIP Descriptor for that Activity, whilst cross-referencing to any medical evidence that you have, or may have already provided which indicates that you should have.

so the statement of decisions states that all the decisions were made without considering reliabily repeately etc.

and they contradicted tgemselves, missed the impact of some conditions.

its a shoddy piece of work with more holes than swiss cheese.]

i need to quote the law that states the reliably repeately etc at them for my mr. is that in the appeal guide?
