The Equality Act was designed to help disabled people when they interact with the world of healthy people, so that they are not discriminated against or limited in what they can do, as an example; providing wheelchair access to shops.

The PIP assessment is assessing people who are already accepted as being disabled so you are not comparing yourself to healthy people but to other disabled claimants, that does not mean that the act is no applicable but your range of options is much more limited.

Ignoring timescales for the moment.

So you can invoke the Act in regard to your assessment, a letter from a solicitor will carry significantly more weight than one from yourself but if the DWP/Assessment Provider calls your bluff and say that they are acting within the terms of the Act then you are left with taking legal action. You may still want to do this but it will be a pyrrhic victory as you will have either already had to submit to the assessment or had your claim closed by the time any legal case comes to court.

But you can't ignore the timescales if your assessment is on Monday and a solicitor letter is going to cost you money and is unlikely to be something that you will be able to arrange over the phone.
