Good Morning everyone, :)

I have some exciting news to report. I received this letter (UCD81-Letter) from UC the other day and today, I checked my account and they paid me £632.07 (which I am not sure if that includes any back-payments or if this what I get now?)

(I thought I cld attach it to this post but can't see how to) Basically it said they had find me unfit work and don't need to supply Fit Notes :)

What I am hoping is this: Surely, PIP-side of DWP could not now find me 'fit for work'? That wouldn't make sense. I havent received any info from PIP yet (this has all been UC-based) so will just have to wait I guess?

Unless you guys can tell me different? :)

Thank you again for ALL the assistance and the documents you supply - I certainly would not be smiling ear to ear this morning and not worrying so much about the coming Xmas if it wasn't for you here x

That’s great news Brian, and I am joining you in smiling.

Unfortunately there is no direct link between PIP and Capacity for Work (UC). The Capacity assessment looks at your ability to cope with the work place and all that is involved with going to work. PIP looks at the difficulties you have with everyday, not work, living and getting around. It is quite common for people to qualify for PIP but still be able to work, although, in my opinion, less common and less likely for people to be assessed as incapable of working but not qualify for PIP.

You are right, you do now just have to wait, although any PIP you do get will be back dated to when you applied for it. Think of it as the DWP sponsored savings scheme.

Hi Everyone :)

Well, my PIP call is this week and I have to tell you - I am extremely anxious about it :(
I will read thru the notes about the phone assessment (I think there is a section in the notes?) but I can't tell you how worried I feel about it.

Any advice would be very much welcome

Hi Brian

The best thing you can do is what you have already suggested and look through the latest guidance on telephone assessments for PIP - there are bout 12 pages. We advise people to do their own recording if you can - but don't inform the assessor what you're doing. Have a drink of water handy. You will find in the guide the types of questions you might be asked. Be prepared that assessors will often throw in a question you are not expecting. Sometimes this can feel like a trick question. Sometimes that may be the case, but sometimes they have to ask something which is personal to a particular claimant.

I hope that it goes well for you. Forty-eight hours after the assessment you can ring and ask for a copy of the assessment report. This is a PA4.

Need advice urgently please:

So PIP cancelled my call with no explanation in December. They called me on Jan 5th and I recorded the conversation as suggested (I was not told in the call I could not and ai was not asked if I was recoding).

The conversation lasted 1hr 20mins and went as well as I thought it could have. She said I had made a good case with lots of paperwork etc and it shldnt take long to hear back. I heard back on the 8th Jan saying they could not award me PIP.

Daily Living I scored 6 points but Mobility was 0

I wanted to challenge this but ai do not know if ai can say I recorded the conversation? I wanted to refer to like this: ‘at 1:03 I made it clear that communicating was sometimes an issue due to the strength of my tablets for the pain. This doesn't seem to have been taken into consideration?’

And

‘At 1:10 I was asked if I am anxious around others and replied Yes. I then gave examples.’

In the report, the examiner says he believes that I am not and have not received treatment for anxiety?? I have taken two different types of pills for depression and anxiety and the NHS page on Anxiety quite clearly states these drugs AND that CBT is the first go-to therapy/counselling for anxiety and I have had more than one course of CBT over many hours and weeks??

I feel some of the info has been ignored completely, especially in consideration to my arthritis in my hip which makes walking some days very difficult. They have said I have no referrals or current treatment, I am on Co-codamol for pains and there isnt much else I can do for arthritis??

It states I have no medication for anxiety and have no current therapy for it?
I have taken almost all the meds over a ten year + period and I listed these. These meds are used for anxiety and depression. When I was 13 yrs old I was off school after my father left us and the doctor diagnosed me with a ‘Nervous Breakdown, I have suffered on and off since all my life and I am now 58 yrs old.

I almost gave up. I received this on the 8th Jan and I was SO depressed about their so-callled ‘findings’ on my health. But I looked at the letter again this weekend and I also listened to the conversation over and made notes and feel I have at least a chance via the Mandatory Reconsideration Notice so I want to get something written very quickly now and sent off via registered post before the end of this week.

Can I mention I recorded the call?

Hi Brian

I would not initially mention that you recorded the assessment.

Contact DWP and ask for a copy of the assessors report called a PA4. When you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and you will now be able to argue against them.

I usually use a highlighter to highlight any inaccuracies, once you have gone through the report you then set out why you are applying for a MR and go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Understand that the assessor is offering an opinion when they say 'in my opinion' you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said., remember they are just an opinion which is not based on fact.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

If there is anything in the report that was not said at the assessment then I would mention that the assessment was recorded and you can prove that what was and not said at the assessment, go through the assessors report thoroughly.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide, half way down the page for details of the process, the PIP area also has template letters that you can use to make the request with.
